All
visitors can freely access and participate in all aspects of the MassageAnywhere.com web site (the "Web site")
without registering or disclosing any personal identifying information. In the event that you choose to register
or volunteer information, this Privacy Policy has been created in an effort to demonstrate our firm commitment to
protecting your privacy on our Web site.
Summary. At no time do we ever share, sell, rent, lend, exchange or release your personal
identifying information with ANYONE unless you tell us it's ok to do so, or we have a good faith
belief that such disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms
of Service; (c) respond to claims that any content violates the rights of third-parties; (d) fulfill or process
financial transactions requested by you; or to (e) protect the rights, property, or personal safety and welfare
of MassageAnywhere.com, its users, providers/members and/or the public. Even in such cases when such
disclosure may be required, we endeavor to release no more than the minimum of information we believe necessary.
Personal Identifying Information. Our Privacy Policy regulates our use of two forms of information:
- Information identifiable to a specific individual, such as real names, identifying photos and credit
card numbers.
- Information that, while not necessarily identifiable to a specific individual, nevertheless may be
used to directly contact an individual, such as phone numbers, street addresses and e-mail addresses.
Use of Information. All personal identifying information is maintained for the sole purpose of
maintaining the Web site and administering the MassageAnywhere.com services.
If you browse our Web site. When you browse our Web site, we collect NO personal identifying
information. You can browse our Web site, search for a massage, even submit a review of a massage
provider, without ever telling us who you are or revealing any personal information about yourself.
If you register as a provider. As part of the registration process, you will (1) select a
member name and (2) provide us with a valid e-mail address at which we may contact you for confirmation.
Your member name is part of your provider profile, and you should not use your real name or other identifying
information as part of your member name unless you are willing to make such information public.
Regardless of the member name your originally select, you may always select a new member name at any time after
registration. Your e-mail address will not be published, except at your option as part of your published
provider profile/ad.
Your responses to the 'Personal Keywords', 'Security Question (Correct Answer)', 'Agenda Filters' and 'IP Block Filter'
questions will be held strictly private and not published at any time. Obviously, if you make your profile
available to searches, your profile may be located and presented in response to a direct or wildcard keyword query
that may match one or more of your personal keywords (or other words actually in your profile and, optionally, your
reviews as well); however, your personal keywords themselves will not be published. The remainder of your
provider profile (with the exception of your e-mail address which is separately protected by an option as selected
by you) may be made available to the public (as long as your membership remains active) according to your
"visibility" preference: (a) fully public and accessible to searches; (b) accessible by direct URL link
only and unavailable to searches; or (c) hidden from all requests.
We require only minimal information. We do not require you to disclose your identity,
credentials, qualifications or other personal information except that which may be necessary for clients (or
us) to contact you or as you may be required by applicable law. For example, you would need to supply
your general location such as your ZIP code or city and you would need to provide some means for clients to
contact you, such as an e-mail address, telephone, pager or fax number. Beyond that, what you choose to
share is strictly your business.
If you register as a Friend. Registration as a Friend requires that you provide us with your
valid e-mail address. The e-mail address you provide to us will not be published without your permission
and will only be used by us to contact you for purposes in connection with your status as a Friend.
If you request a financial transaction. If you purchase a product or service, or otherwise make
a payment or donation of some form, we use your financial information (i.e. your provided billing information
and other related personal information) to check your qualifications, to bill you for products and services and
to enable you to participate in programs in which you may elect to participate. By making a purchase, or
engaging in any other kind of activity or transaction that uses financial information, on MassageAnywhere.com,
you consent to our providing your financial information to our service providers and to such third parties as we
determine are necessary to support and process your activities and transactions, as well as to your credit card
issuer or bank for their purposes. These third parties may include the credit card companies and banking
institutions used to process and support the transaction or activity. In some cases, we may enter into a
promotional relationship with another company in which we prominently display their brand name or trademarks on
pages of the Web site. These pages are known as "Co-Branded Pages" and these companies are known
as "Co-Branded Companies." If the page on which you submit information is a Co-Branded Page, or
was accessed by clicking on a link on a Co-Branded Page, you agree your information may be shared with the
associated Co-Branded Company and be subject to their own privacy policies, over which we have no control, and
you agree that we are not responsible or liable for any of their actions or omissions. Additionally, you
agree that we may use any information so submitted to us by such third parties in the same manner in which we
are entitled to use and disclose any other information that you submit to us.
Special cases in which we may share information. We may also disclose personal identifying information and
information relating to you when we have a good faith belief that such disclosure is reasonably necessary to (a)
comply with legal process; (b) enforce the Terms of Service; (c) respond to claims that any content violates the rights
of third-parties; and/or to (d) protect the rights, property, or personal safety and welfare of MassageAnywhere.com,
its users, providers/members and/or the public. We may also disclose such information to our subsidiary and parent
companies and businesses, and other affiliated legal entities and businesses with whom we are under common corporate
control. All of our parent, subsidiary and affiliated legal entities and businesses that receive your information
from us will comply with the terms of this Privacy Policy with respect to their use and disclosure of such information.
Should MassageAnywhere.com, in whole or in part, ever be transferred to a third party in the event of a transfer
of ownership or assets, or a bankruptcy, any transfer of information will continue to be subject to the terms of our
Privacy Policy to the extent permitted by law. In no event will we sell or disclose databases
containing cardholder or bank account information (e.g. bank card/account numbers, bank card/account billing
addresses, etc.) or bank card/account transaction information to third parties.
If you otherwise volunteer information. If you volunteer personal identifying information, we
will not share it with anyone else except as otherwise noted in this Privacy Policy unless you tell us it's ok
to do so. For example:
- If you submit a review: If you choose to submit a review of a provider, you are not required to
disclose any personal identifying information about yourself and your review may be submitted anonymously.
If you do choose to identify yourself, we give you control over how much of that information may be made available
to the provider you are reviewing and how much may be made available to the public who reads your review, AND you
may also later amend your privacy choices on any published review you previously submitted. It is a
violation of our Privacy Policy for the reviewer or provider to include, within a review, any personal identifying
information regarding any party without the express permission of that party. Please read our
Provider Review System and Policy for more information.
- If you file a complaint: If you file a complaint regarding a provider, we do not require you
to provide us with any personal identifying information, though we may ask for it to expedite processing
or to contact you if we have further questions.
- Customer service correspondence: We retain records of correspondence in order to measure and
improve our customer service and to investigate possible violations of our Terms of Service. We may,
however, over time, delete such records as permitted by law.
Other Topics
Cookies. As described in our Cookie Policy, we use temporary
"session" cookies for access to the members-only and Friends-only areas of our Web site.
Otherwise, you are not required to accept a cookie, though by doing so, you may have access to additional
features not otherwise available. Our session cookie contains only a simple, anonymous unique identifier.
It is not saved on your hard drive and should disappear completely when you exit your browser. We do not
share cookies with other web sites.
Some features of our Web site may also provide you with a "remember me on this computer"
option. If you choose this option, a persistent cookie will be saved on your hard drive which will enable
you (and anyone else who uses your computer) to access those features of our web site without having to log back
in. This is a convenience for you, but for your privacy and security, and because this persistent cookie
may contain your username, password and/or e-mail address, you should not use the "remember me on this
computer" option if you share your computer with other people. Our persistent cookie will remain on
your hard drive until it expires or you clear the cookies in your browser.
Web beacons. We do not use web beacons. Web beacons are electronic images, including
"single-pixel GIFs", used by some web sites, advertisers and others to count or identify accesses of a
particular page or to enable access to certain cookies. Again, we do not use web beacons.
Communications with you. We, or others on our behalf, may contact you, by e-mail or otherwise, with:
(1) confirmatory e-mails when you activate / deactivate your account or make or cancel a purchase; (2) responses to
inquiries, including requests from you for lost username / password; (3) e-mails received and relayed from the public
at-large in response to your ad, including e-mails which may be of a commercial nature; (4) notifications pursuant to
our Provider Review System and Policy; (5) billing and compliance issues; and (6)
occasional news and/or commercial promotions. We do not publish your contact information without your permission,
and we therefore are not responsible for communications you may receive from the public in response to your ad or otherwise.
IP Addresses. An IP address is a number automatically assigned to your computer whenever you
access the Internet. All computer identification on the Internet is conducted with IP addresses, special
numbers that allow computers and servers to recognize and communicate with each other. IP addresses are
not considered personal identifying information, and, except as provided by this Privacy Policy, it is not
otherwise our policy to share or release IP address information to anyone for any reason, nor to use IP addresses
to personally identify any visitor or member. We may use IP addresses in order to conduct system
administration, to report aggregate (not personally identifiable) information to sponsors and advertisers, to
conduct Web site analysis, and to protect against fraud and abuse. IP addresses may also assist with
initial prefilling of city/ZIP code fields for the SmartSearchSM.
If a visitor requests pages from MassageAnywhere.com, the MassageAnywhere.com servers may enter the visitor's
IP address into a system log. If you choose to contact a person by e-mail or other means, you understand
that your IP address may be transmitted to that person. We may, if necessary or appropriate in our sole
discretion and opinion, use, share and/or disclose IP addresses for the purpose of identifying or screening
for persons who refuse to comply with our Terms of Service and/or those persons who may threaten or pose a risk
to our Service, Web site, customers or others.
External links. Our Web site may contain links to and interface with external third-party web sites. For
example, you may encounter a link to a provider's homepage in his/her profile, or you might click on an advertising banner
belonging to another web site. In addition, maps (via various
buttons) and some geographic
aids are provided via Google.com and your use of their
maps and geographic aids are covered by Google's
own privacy policy. By using our Web site, you use and/or interface with these features at your own risk.
MassageAnywhere.com does not share personal identifying information with these external third-party web sites and exercises no
authority over the privacy practices, policies and procedures of external third-party web sites. However, we do wish to
ensure the integrity of our Web site, so any comments pertaining to our Web site or any sites to which we link are greatly appreciated.
Inquiries. Inquiries not otherwise covered by this Privacy Policy regarding an individual's
identity, relationship with us or his/her activities on our Web site will be ignored. To that end, if it's
not publicly posted on our Web site, it's not ours to share.
No access by children. Our Terms of Service do not authorize use of our Web site by children.
Security.
MassageAnywhere.com has security measures in place to protect the loss, misuse and alteration of information
under our control. Our secure server software (SSL) is the industry standard and among the best software
available today for secure commerce transactions. We encrypt all of your financial information as it
travels over the Internet, and, to the extent that we may store financial information on our servers, it is
also stored in encrypted form. |

Nevertheless, despite our efforts, your information may be transferred to and maintained on computer networks
which may be located outside of the state, province, country or other governmental jurisdiction in which you reside,
and the country or jurisdiction in which these computer networks are located may not have privacy laws as protective
as the laws in your country or jurisdiction. Further, the very nature of the Internet and the complexities of
technology involved preclude us from ensuring or warranting the security of such information or any information
transmitted to or through the Service, and each user uses the Service at his/her own risk.
Opt-out. If you are a provider, you control the information which is published in connection
with your ad and whether your ad is publishable. You may choose not to participate in our
Provider Review System. You may also choose not to publish your e-mail address and, optionally, to
have e-mails from the public at-large in response to your ad relayed to you privately. You may also
remove your e-mail address from your published profile record altogether, but doing so may make your ad not publishable
and may jeopardize your account standing. These "opt-out" features are available as updates to
your provider profile/ad. Other than that, there's nothing left to opt-out.
Correction / update / removal. If you have posted personal identifying information to our Web site,
you may correct, update or remove it as follows. If you are a provider/member, you may update your
registration information, ad and photos, and attend to your reviews by logging in and choosing the appropriate
clickable option at the top of any page. If you later terminate your membership, your account, ad and
photos will no longer be published and may subsequently be removed from the system. If you are a user, you may
amend any currently published review you previously submitted with the password you selected when you initially
submitted the review. If you did not select a password or you have forgotten it, you will not be able to
correct or update the previously submitted review. If you are a Friend, you may change your Key and the
extent to which you make your Key, e-mail and photo available to others via our Friends-only
page while you have a valid token for access. If your token should expire or otherwise be suspended,
you will no longer have access and we will no longer publish your Key, e-mail or photo. In unusual
circumstances, you may contact us for assistance.
Changes. Our Privacy Policy may be revised over time as new features are added to the
MassageAnywhere.com service or as we incorporate suggestions from our customers. If it becomes necessary
that we use or disclose your personally identifiable information in a manner materially different from that
stated at the time we collected the information, you will have a choice as to whether or not we use or
disclose your information in this new manner. In such a situation, the change would be "opt-in"
and you would not be required to take any pro-active action on your part to "opt-out" of any new
disclosure in order to preserve your privacy.
The final word. Because we're frank and honest when it comes to your privacy, we owe it to you
to mention the unmentionable. Specifically, no matter how firm and resolute a privacy policy may be, no
web site can ever guarantee absolute privacy. Your privacy may be breached lawfully or unlawfully by
agents of the government, by your telephone or cable company, by an Internet service provider (ISP), by a
hacker or other criminal forces including rogue or malevolent employees, forces unknown or overlooked, and last
but not least, by human ignorance or error. However, we sincerely do work hard to protect your privacy and
if you have any questions or suggestions, we are always interested.
